     T-1160-90

Montreal, Quebec, this 6th day of May 1997

Before the Honourable Justice Marc Nadon

BETWEEN:

     C & B VACATION PROPERTIES INC. and

     CORPORATION DROVELLE LTÉE,

     Plaintiffs,

     - and -

     HER MAJESTY THE QUEEN,

     Defendant

     JUDGMENT AND REASONS FOR JUDGMENT

NADON J:

On March 25, 1997, I allowed the Plaintiffs" action against the Defendant with interest and the additional indemnity provided under Article 1619 of the Civil Code of Quebec (CCQ).

By my judgment, I directed the parties to calculate, in accordance with my reasons, the specific amount of compensation to which the Plaintiffs were entitled. I have now been advised by counsel that the parties have agreed that the fair market land value is $2,343,000.00. As a result, the Plaintiffs are entitled, over and above the sum of $1,520,000.00 which they have already received from the Defendant, to a further sum of $823,000.00.

The Defendant is therefore ordered to pay to the Plaintiffs the sum of $823,000.00 with interest in accordance with Section 36 of the Expropriation Act and post-judgment interest as provided by article 1619 of the CCQ, as well as costs on a solicitor-client basis.
