REED, J.:



[1]      This application was for an order of mandamus to require a visa officer to complete the assessment of the applicant's visa application. It appears to have arisen out of a miscommunication between the visa office and the applicant's counsel. In any event, by the time the hearing of the judicial review took place, the matter had been straightened out and the only issue left was whether costs should be awarded.


[2]      The applicant seeks costs on the ground that there was a duty of candour which the respondent did not fulfil in its communications with his counsel.


[3]      After reviewing the file and hearing counsel's submissions, I cannot conclude that the miscommunications were of a type that constitute "special reasons" within Rule 22 of the Federal Court Immigration Rules.


[4]      The application will be dismissed, on consent, with no costs awarded to either party.
