(re: Appointments to the Exceptions Committee)

UPON READING the motion record and the consent of the parties;

THIS COURT ORDERS that:

  1. The following individuals are appointed to the Exceptions Committee, as defined in the Settlement Agreement at s. 1.01 and approved by this Court in McLean v Canada, 2019 FC 1075:

    1. The Honourable Justice Marie Deschamps as the individual agreed to by the parties, as set out in s. 11.01 (1) of the Settlement Agreement;

    2. Ms. Kathleen Lickers, a Survivor Class Member, as defined in s. 1.01 of the Settlement Agreement, and as set out in s. 11.01 (1) of the Settlement Agreement;

    3. Ms. Catharine Moore, as one of Canada’s legal counsel who participated in the negotiation of the Settlement Agreement, as set out in s. 11.01 (1) of the Settlement Agreement; and

    4. Ms. Mary Thomson, as one member of Class Counsel who participated in the negotiation of the Settlement Agreement, as set out in s. 11.01 (1) of the Settlement Agreement.

  2. The Defendant will pay the reasonable costs of the participation in the Exceptions committee of Madam Justice Deschamps, Ms. Kathleen Lickers and Ms. Catharine Moore as set out in the Settlement Agreement.

  3. The participation in the Exceptions Committee of Ms. Mary Thomson, will be paid from the Post-Implementation Fees, as set out in the Settlement Agreement.
