At the commencement of the hearing of this appeal, counsel for the appellant asked us to join with it the appeal in Court File No. A-399-98, so that they could be heard together

because they are related. We acceded to his request, counsel for the Crown not objecting and we heard both appeals together.
Despite the interesting and erudite arguments advanced by Mr. Galati for the appellant in each case, we are satisfied that the Motions Judge in each appeal made no error which warrants our intervention.
We will, therefore, dismiss both appeals.
A copy of these brief reasons shall be filed in Court File No. A-399-98 and when so filed, shall be considered to be the disposition of the appeal in that file.
