ASSESSMENT OF COSTS - REASONS
FRANÇOIS MARTIN, ASSESSMENT OFFICER
[1] This is an assessment of costs pursuant to a judgment dated January 14, 2002, by the Honourable Justices Desjardins, Décary and Noël dismissing the applicant's application for judicial review with costs.
[2] Counsel for the respondent filed his bill of costs on November 7, 2002, accompanied by a request that a decision be made without personal appearance by the parties.
[3] On November 18, 2002, a copy of the respondent's bill of costs was sent to the applicant so that he could make written representations, but he has not done so as of today. In light of the foregoing, I am prepared to assess the costs in favour of the respondent.
[4] The fees requested are allowed, except for the claim under item 26 for the assessment of costs. Since the assessment of costs was not disputed, two units are allowed.
[5] The disbursements are allowed as claimed.
[6] The respondent's costs are accordingly assessed and allowed in the amount of $2,052.54.
