[1] In this case, the Canadian International Trade Tribunal was required to consider a number of factors in determining the cause of injury to the domestic steel industry in the last half of 2000 and the first quarter of 2001. It appears to have considered the relevant factors and concluded that the presence of dumped goods in the Canadian market in this case was not a cause of injury to the domestic industry.
[2] The applicant concedes that the standard of review is very high in a case such as this. The decision of the Tribunal is one that is well within its field of expertise. Despite the able argument of counsel for the applicant, we are unable to conclude that the Tribunal based its decision on an erroneous finding of fact that it made in a perverse or capricious manner or without regard to the material before it.
[3] For these reasons, the application will be dismissed with costs.
